Two questions for the experts...
I am on J1 visa and have received a home residency requirement waiver. Do the experts here know if I can apply for a J1 visa extension (after receiving the waiver)? I read somewhere that it may not be possible to do so.
Also, are there are any foreign travel restriction on a J-1 visa?

Getting a waiver implies that you want to change your status. So renewal may not be a good idea. I would talk to a lawyer about the implications.

I doubt, it has anything to do with the filing AOS before a certain date. Whatever fee is mentioned on uscis website will apply for everybody.

Hello,
Not that I know ... the worst case scenario is that your green cards are physically mailed to you and then they are returned 'cause nobody was at the home (though normally, it should just sit with your other mail).
When you reenter US, stand in the regular visitor line.... if your card is issued, the IO will know and stamp your passport w temporary green card and allow you in the US.

its good to use your OPT card as long as its vaild and then move to H1, there is no time frame for stamping, its always good to go to your home country and then get it stamped,but once you start working on H1(your payrolls starts on H1) then your H1 clock starts

From my experience The people at the national center have no idea whats happening when compared to the guys at the specific centers. The national centers issues generic solutions. (Say fill a form and wait for 45 days. If after 45 days there is no answer they again send the form, etc) If you really want to know more or get proper action, the people at the specific centers will have to be contacted.
The old way to get to the specified center is back. Dont listen the messages, just press the order of the buttons and it will work.

Hello,
Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.

I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.
Can anyone please help me with below queries
1. Do i need Original petetion from previous employer for Green Card processing ?.
2 Should i return H1 petetion or not to my previous employer ?.
2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.
I would really appreciate and thankful , if you clarify my doubts.

Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

They may not accept a certificate from india, medical exams has to be done by a civil surgeon in your area who is authorized to perform the tests.

Q1) I would like to take a US consulate appointment for visitor's visa for my father. We are from southern Andhra Pradesh and Chennai consulate is convenient for us. Since Hyderabad has US consulate, does whole of Andhra come under HYD consulate jurisdiction? or can we take appointment in Chennai Consulate? Could you please let me know? My father is going for visa for the first time.
Q2) If visitor passport is expiring in next eight months and if the visitor is residing in US, is it possible to renew the passport here? Or the person has to go back to India and renew the passport there. I would just like to help my parents with the paper work and get it done if possible when they are here.
