    U.S. companies are also clamoring for more H1B visas to allow foreign software engineers and other skilled workers into the country.

    The 65,000 visas allotted for 2007 were taken by the end of May last year, months before the end of the fiscal year in September, said Jack Krumholtz, the head of Microsoft Corp.'s government affairs office. It is also difficult to get permanent U.S. residency for foreign workers who would like to stay, he said.

    "This is becoming for high-tech companies a huge retention issue," Krumholtz said. "We will start to see highly valued tech employees emigrate back to their home countries."

    My wife who is on H-4 is planning to go to India in December this year and would need to appear at the chennai consulate for visa renewal. I am currently in my 7th year with my labor stuck in PBEC. I am due for my 8th year extension before April 2007 but am waiting to get my labor/I-140 so I could file for a 3 year extension.

    My question/concern is about my wife's renewal. I keep hearing that ppl are facing issues like name check/security issues for visa renewal. My good friend and a relative are stuck in india for 8/6 months respectively waiting for a H-1B visa issuance (Embassy's already charged the visa issuance fee but have not stamped the visa on both passport citing various reasons).

    What issues should I be concerned about? My visa has expired this past april. Would the embassy insist for my visa renewal. Would be a issue that only three months remain in my wife's H-4 renewal papers? I would greatly appreciate if ppl could share their experiences to help through this unnerving process.

    Hi,

    I am trying to understand the I-485 process and unfortunately don't have a lawyer to ask questions.

    Can someone please explain why copies of the passport (showing biographical data) are required? Which form asks for them - I did not find anything in I-485. That form only asks for a copy of the visa, if issued within the last year.

    Well I have been waiting for a reply, seems like no one has answered my question. Can someone please post some suggestions. urgent

    You have 2 options. Either use your old H1 which is still valid (assuming u still have a valid visa stamp) and enter US (carry a latest offer letter from employer). If you use the old H1, then you will only have 2 more years of H1 time left.

    You can file for a fresh H1 visa in Master's quota under consular processing and when its approved, attend the Visa interview, get a new H1 stamp, and re-enter using the fresh stamp. This way, you will get fresh 6 yrs time on H1.

    My PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
    If I were to change my job now, will I lose my PD or can the new company refile my new I-140?

    Yes, it can be done. Basically, you have to show that the work experience is at least the equivalent of a College degree. There are people, called "evaluators" (or something like that) that analyse all the credentials and work experiences to determine that equivalence. Immigration attorneys know how to use those "evaluators" whose "evaluations" are usually accepted by USCIS.

    Simply going by the voting standpoint, I think between now and 08 elections, politicians will have little incentive do anything about our case (i.e., legal immigration) realistically. I'm not sure whether we represent a % of voter population that's high enough for them to place our case on their priority list. Moreover, giving us GC now will probably benefit them (in terms of votes) at least after 5.5 years once the GC holders are citizens and hence able to vote.

    Just my thought for what its worth.

    Following is the situation:

    My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
    Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
    Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).

    Falling short of 10 weeks to get the 365 days rule

    Options that I learnt for me getting 7th yr extension and staying in the country:

    Option1:
    Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Convert from H4 to H1 and start working.

    Option 2:

    Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Stamping in canada to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)

    Option 3:

    Go back to India for 3 months wait till June 20th,
    File for 7th year extension based on the 365 days rule
    Stamping in India to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)


    Option 4:

    Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

    Can the gurus/experts please put in any issues I might be running into or if any of the option above are not at all feasible(may be I am ignorant)

    - H1B is good as long as employer-employee relationship is maintained, which in your case should be fine
    - You may have issues with 140 approval (Just my opinion, I may be wrong)
    - If you are considering H1 transfer, that may have issues as you may not have latest paycheck..

    Did we ever think about forming a team with other like minded people under one banner? I think we will be able to effect something if all Pro CIR people join hands together and pool our resources. Any suggestions??

    AILA sees 11 milllion clients at their door step, so they support more of CIR which mostly favours illegals

    Compete America is more towards corporate interest, they will be happy if they get more H1Bs, they do support more EB green cards, but I don't think itz their top agenda

    IV is formed by guys who are really victims, so we know whatz in our best intrest, none of other groups are not victims they just want to take advantage of current situation

    never the less their policy do align with ours , so I am sure IV core members are in touch with these organization and work them more closly

    My EAD and AP application got rejected because of missing signature on the form.Now i am planning to file on my own with out the help of attorney as he is charging me too much for refile.

    So needed help in drafting the letter addressing the situation.Above all i didn't receive my application back and USCIS personnel told me that i can refile as a fresh application if i don't receive in 30days.And i am already completed the 30days.I do have the rejected application LIN number and my 485 receipt.

    Please advice me what to do i want to avoid attorney.

    Hi,

    I have a EB3 labor and 140 approved with PD->12/2002. By 12/2002 I do have 5yrs experience but now (2007) I do have 5yrs experience and I am eligible for EB2.

    My question to the gurus is can I use my EB3 PD for EB2 with new employer and can apply for 485 which is current for 12/2002?

    Also, while during this transistion/waiting for EB2 labor and 140 with the new company what happens that my previous employer cancels my GC application? Can I still use that PD ?

    Thanks for the quick response.
    I couldnt find the form on the uscis website, which generally lists supplemental forms next to the main ones. Couldnt even find a link to this, so wasnt sure if my doc was doing the right thing or following some old procedure.

    One more question : I-693 has 4 copies (one for uscis, one for self, one for doc etc). Does it matter which copy goes to uscis (since they are basically the same, except for the text in the bottom which denotes the copy).
    Because I think my doc put his copy in the sealed envelope, and gave me a photocopy of that.
    Should I go back and have him redo the form (he has bad handwriting too, like most doctors)?

    I have started a new thread to remind everyone (who has not yet contributed) to contribute for the just concluded Advocacy day.

    Take some funds from any money that you put aside this year for charitable causes or temple donations. All that you contribute is money well spent - as eventually it would benefit a number of people and entire families. So helping people better their lives is like contributing to charitable causes.
